1. The Reference Defined
San Jose Residents Directory is privately operated informational material about public rolls, record indexes, and historical collections connected with San Jose, California. It does not host government records, act for a custodian, or have an affiliation with an office, court, county, state agency, or library.
2. Permitted Use
Use the pages only for lawful, personal, journalistic, genealogical, historical, civic, or similar purposes. You may not use the reference or anything reached through it to:
- Stalk, harass, intimidate, threaten, or harm any person
- Locate someone protected by a restraining or protective order
- Commit identity theft or fraud
- Make a decision regulated by the FCRA, including credit, employment, housing, or insurance decisions
- Scrape, reproduce, or republish the pages at scale
- Disrupt the reference, its security, or its operation
3. No Consumer Reports
San Jose Residents Directory is not a consumer reporting agency under the Fair Credit Reporting Act, 15 U.S.C. §1681 et seq. Material on these pages and results from linked tools are not consumer reports. They may not be used to assess eligibility for credit, employment, housing, insurance, or another purpose covered by the FCRA.
4. External Destinations
County, state, library, archive, and third-party destinations maintain their own terms and privacy policies. Sponsored search tools are also operated by other companies. San Jose Residents Directory does not control their content, availability, charges, or data practices.
5. No Warranty
The reference is provided "as is" and "as available," without warranties of any kind. No promise is made that a page, record description, link, portal, or search result is accurate, complete, current, available, or fit for a particular purpose.
6. Liability Limits
To the fullest extent permitted by law, the operators are not liable for direct, indirect, incidental, consequential, special, or similar damages arising from use of these pages or an external resource, including an action taken from a record found through them.
7. Indemnity
You agree to defend, indemnify, and hold harmless the operators from a claim, demand, loss, or expense, including reasonable attorneys' fees, that results from misuse of the reference or breach of these terms.
8. Site Materials
Original text, design, logo, and layout are protected by copyright. Linking to a page and quoting a short attributed excerpt is allowed. Republishing full pages or systematically copying the material is not.
9. Revisions
A revised version may be posted here from time to time. Continued use after a revision is posted constitutes acceptance of the changed terms.
10. Access Restrictions
Access may be blocked or limited for a user who violates these terms, abuses the pages, or threatens their operation. This may occur at the operators' discretion and without advance notice.
11. California Law
California law governs these terms without regard to conflict-of-law rules. References to public records concern the California Public Records Act, Government Code §§7920.000-7931.000. Privacy questions involving covered businesses may also implicate the California Consumer Privacy Act and California Privacy Rights Act, including Civil Code §1798.100 et seq.; those statutes do not make this private reference the custodian of a government record.
12. Severability
If a court finds one provision unenforceable, that provision will be limited or removed as needed and the remaining terms will continue in effect.
